3. ELIGIBILITY
You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.
If you are using the Service on behalf of a business or organization, you represent and warrant that you have the authority to bind that

4. ACCOUNT REGISTRATION
4.1 Account Creation
To use the Service, you must create an account by providing accurate and complete information, including:
- Business name
- Contact information
- Google Business Profile information
- Payment information
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
You agree not to:
- Share your account credentials with others
- Create more than one account without our written permission
- Use another person's account without permission
4.3 Account Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for:
- Violation of these Terms

5. ACCEPTABLE USE

You agree NOT to:

- Send unsolicited messages to individuals who have not engaged with your business
- Send messages to individuals who have opted out
- Send excessive or harassing messages
- Purchase or use third-party contact lists
**Illegal Activity:**
- Violate any local, state, national, or international law
- Engage in fraudulent activity
- Impersonate any person or entity
- Infringe on intellectual property rights
**System Abuse:**
- Attempt to gain unauthorized access to the Service
- Interfere with or disrupt the Service
- Reverse engineer, decompile, or disassemble the Service
- Use automated scripts or bots without authorization
- Overload or harm our systems
**Content Violations:**
- Send threatening, abusive, or defamatory content
- Send content containing malware or viruses
- Send sexually explicit or obscene content
- Send content promoting illegal activities
5.3 Compliance with Laws
You are solely responsible for ensuring your use of the Service complies with:

- CAN-SPAM Act

6. CUSTOMER DATA & CONSENT
6.1 Customer Consent
You represent and warrant that:
- You have obtained proper consent from customers to send them SMS and email communications
- Your customers have engaged with your business
- You maintain records of customer consent
- You honor all opt-out requests promptly
6.2 Opt-Out Compliance
You agree to:
- Honor all opt-out requests within 10 business days
- Include opt-out instructions in all messages
- Maintain an internal do-not-contact list
- Not contact customers who have opted out
6.3 Data Accuracy
You are responsible for:
- The accuracy of customer data you upload to the Service
- Maintaining up-to-date customer information
- Removing invalid or outdated contact information

7. PRICING & PAYMENT
7.1 Subscription Plans
Revvie offers subscription-based pricing as described on our website. Current pricing:
- **Monthly Subscription:** $79/month
- Includes: 750 SMS messages, 1,000 emails, and all Service features
Pricing is subject to change with 30 days' notice to existing customers.
7.2 Free Trial
New customers may be eligible for a 14-day free trial. At the end of the trial period, you will be automatically enrolled in a paid subscription
unless you cancel.
7.3 Payment Terms
- All fees are billed in advance on a monthly basis
- Payment is due immediately upon subscription
- Fees are non-refundable except as required by law
- You authorize us to charge your payment method on file
7.4 Billing
We use Stripe to process payments. You agree to:
- Provide accurate and complete billing information
- Update your payment information as needed
- Pay all applicable taxes
7.5 Late Payment
If payment fails, we may:
- Suspend your access to the Service
- Charge late fees of $15 or 1.5% per month (whichever is greater)
- Terminate your account after 30 days of non-payment
7.6 Refund Policy
Refunds are provided only in the following circumstances:
- Service outage exceeding 24 consecutive hours (pro-rated refund)
- Duplicate charges due to billing error
- Cancellation within 7 days of initial paid subscription
Refunds are NOT provided for:
- Unused messages or emails
- Partial billing periods
- Dissatisfaction with results
- Violation of Terms resulting in termination

8. USAGE LIMITS
8.1 Message Limits
Each subscription includes:
- 750 SMS messages per month
- 1,000 email messages per month
8.2 Overage
If you exceed your monthly limits:
- Additional messages will not be sent
- You will be notified when you reach 80% and 100% of your limit
- You may upgrade your plan (when available)
8.3 Fair Use
We reserve the right to limit or throttle your usage if we determine you are abusing the Service or engaging in practices that
harm our systems or reputation.

9. THIRD-PARTY INTEGRATIONS
9.1 Square Integration
If you connect your Square account:
- You authorize us to access transaction data necessary to send review requests
- You are responsible for maintaining your Square account in good standing
- We are not responsible for issues with Square's service

If you connect your Google Business Profile:
- You authorize us to access your business information and review link
- You are responsible for maintaining accurate business information
- We are not responsible for changes Google makes to their platform

We are not responsible for:
- The availability or performance of third-party services
- Changes to third-party APIs or terms
- Data breaches or security issues with third parties

10. INTELLECTUAL PROPERTY
10.1 Our IP
The Service, including all content, features, and functionality, is owned by BH Solutions LLC and is protected by copyright, trademark, and
other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose.
You may NOT:
- Copy, modify, or create derivative works

12.3 Delivery Rates
We do not guarantee:
- 100% SMS or email delivery
- That messages will not be marked as spam
- That carrier networks will deliver messages
SMS delivery depends on carrier networks, 10DLC registration, and customer opt-in status.
12.4 Availability
We strive for 99.9% uptime but do not guarantee:
- Uninterrupted access to the Service
- Error-free operation
- That defects will be corrected promptly

13. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
13.1 Damages Cap
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU
PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

15. TERMINATION

- You fail to pay fees

15.3 Effect of Termination
Upon termination:

- We may delete your data after 30 days
- You remain liable for all fees incurred prior to termination
- Provisions that should survive (e.g., liability limitations) will continue
15.4 Data Export
Before termination, you may export your customer data. After 30 days, we have no obligation to retain or provide your data.

17. DISPUTE RESOLUTION

**Exceptions:** Either party may:

- Seek injunctive relief in court for IP violations

- Conducted in Clark County, Nevada (or your county of residence)

17.3 Class Action Waiver

18.6 Force Majeure
We are not liable for failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism,
internet failures, or government actions.
18.7 Export Controls
You agree to comply with all export and import laws and restrictions. You may not use the Service if you are located in a country
embargoed by the United States.
